Terms of Service

These Terms govern your access to KushMetaX websites, tools (including the Doginal Dogs evaluator and DogiDex features), content, and related services (“Services”). By using the Services you agree to these Terms.

Eligibility

You must be able to form a binding contract in your jurisdiction and comply with applicable laws when using the Services.

Accounts

You are responsible for safeguarding credentials for any KushMetaX account you create. Activities under your account are your responsibility unless you promptly notify us of unauthorized access (where feasible).

Paid subscription (Doginal Dogs Plus)

Subscriptions are sold through Paddle, our Merchant of Record. Paddle collects payment, calculates and remits taxes where applicable, sends receipts/invoices Paddle must provide under its role, and manages subscription lifecycle tooling such as cancellations you request through the Paddle customer portal.

Your agreement with Paddle supplements these Terms where payment mechanics are concerned. Use the same email for KushMetaX accounts and Paddle receipts so we can reconcile access for DogiDex and Plus features reliably.

Acceptable use

You will not misuse the Services, attempt unauthorized access, interfere with integrity or performance, scrape in a manner that violates technical limits we apply, transmit malware, or use the Services to violate laws or third-party rights.

Tools and valuations

Evaluations, dashboards, rarity scores, and related outputs reflect models and datasets that update over time. They are informational and not investment, legal, financial, tax, or professional advice. You use outputs at your own risk.

Intellectual property

KushMetaX branding, site design, software, and original content are protected by applicable laws. You receive a limited, revocable license to use the Services as offered. Do not copy, modify, or reverse engineer except as allowed by law.

Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUSHMETAX AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM THE SERVICES. AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID KUSHMETAX FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.

Indemnity

You will defend and indemnify KushMetaX against claims arising from your misuse of the Services, your content, or your violation of these Terms, to the extent permitted by law.

Changes

We may update these Terms; the updated date will be posted on this page. Continued use after changes constitutes acceptance for non-material updates where permitted by law.
